This website is operated by Sparkles & Stardust ("we", "us", "our"). Sparkles & Stardust is a handmade personalized gifting and drinkware brand based in Mumbai, India, selling through sparklenstardust.com.

Our store is hosted on Wix.com Ltd, which provides us with the online e-commerce platform that allows us to sell our products and services to you.

2. ACCEPTANCE OF TERMS

By visiting our website and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following Terms of Service ("Terms"), including all additional terms, conditions, and policies referenced here or available by hyperlink.

These Terms apply to all users of the site, including browsers, vendors, customers, merchants, and contributors of content. Please read these Terms carefully before accessing or using our website. If you do not agree to all the terms and conditions of this agreement, please do not use the website or place an order.

Any new features or tools added to the store shall also be subject to these Terms. We reserve the right to update, change, or replace any part of these Terms by posting updates on our website. It is your responsibility to check this page periodically for changes. Your continued use of the website following the posting of any changes constitutes acceptance of those changes.

3. ORDERS & ORDER ACCEPTANCE

Placing an order on our website constitutes an offer to purchase. An order is only confirmed once payment has been successfully received and we have sent you a confirmation email or message.

We reserve the right to refuse or cancel any order at our discretion, including in cases of:

  • Suspected fraudulent activity

  • Errors in product listing, pricing, or availability

  • Inability to fulfil personalization requests as submitted

  • Items being out of stock

In such cases, the full amount paid will be refunded to your original payment method within 7–10 working days.

4. PERSONALIZATION & MADE-TO-ORDER POLICY

The majority of our products are handmade and personalized to order. By placing a personalized order, you agree to the following:

  • Personalization details (name, initial, quote, color choice) must be provided accurately at checkout. We are not responsible for errors caused by incorrect information submitted by the customer.

  • Once production begins, personalized orders cannot be cancelled, modified, exchanged, or refunded. This is standard practice for made-to-order goods and aligns with Section 2(9) of the Consumer Protection (E-Commerce) Rules, 2020.

  • Slight variations in color, print alignment, texture, or finish are inherent to handmade products and are not considered defects.

  • Colors may vary slightly from what appears on your screen due to monitor calibration.

5. CANCELLATION POLICY

  • Non-personalized products (in-stock ready-to-ship items) can be cancelled within 12 hours of order placement.

  • Personalized products can be cancelled within 6 hours of order placement, provided production has not begun.

  • Once the cancellation window has passed, orders cannot be cancelled.

  • To request a cancellation, email sparklesnstardust@gmail.com with your order number.

6. SHIPPING & DELIVERY

  • We ship pan-India through trusted courier partners.

  • Standard dispatch timeline: 5–7 working days from order confirmation. During festive seasons and sale periods, this may extend to 10–12 working days.

  • Delivery timeline post-dispatch: 3–7 working days, depending on your location.

  • A tracking link will be shared once your order is dispatched.

  • Shipping charges are calculated at checkout and are non-refundable once the order is dispatched.

  • We are not responsible for delays caused by the courier partner, natural disasters, strikes, or unforeseen circumstances.

7. DAMAGES IN TRANSIT

We take great care in packaging every order. However, in the rare event that your order arrives damaged:

  • An unboxing video is mandatory to raise any damage claim. Videos must show the parcel being opened without cuts or edits.

  • Claims must be raised within 24 hours of delivery by emailing sparklesnstardust@gmail.com with your order number, the unboxing video, and photos of the damage.

  • Claims raised after 24 hours or without an unboxing video cannot be entertained.

  • Once verified, we will either replace the damaged item or issue a refund, at our discretion.

8. RETURNS & REFUNDS

  • Personalized items are strictly non-returnable and non-refundable, with no exceptions except in cases of damage in transit (see Section 7) or manufacturing defect verified by us. This applies to all customized drinkware, personalized coasters, personalized hampers, and any product made to order.

  • Non-personalized items (ready-to-ship stock items) may be returned within 3 days of delivery, provided:

  1. The item is unused, in its original packaging, and in resellable condition

  2. The invoice or order confirmation is included

  3. The item is shipped back by the customer at their own cost, through a trackable courier service

  • Return requests must be raised within 3 days of delivery by emailing sparklesnstardust@gmail.com with your order number and reason for return.

  • Once we receive and inspect the returned item, refunds are processed to your original payment method within 7–10 working days.

  • We do not offer refunds for:

  1. Any personalized or customized product (regardless of reason, other than transit damage or manufacturing defect)

  2. Change of mind on personalized orders

  3. Incorrect personalization details submitted by the customer

  4. Slight variations in colour, print, or finish (inherent to handmade products)

  5. Return shipping costs

  6. Delays caused by the courier partner

9. PAYMENT

  • All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

  • We accept payments via UPI, credit/debit cards, net banking, and other methods supported by our payment gateway.

  • Full payment is required at the time of order placement. We do not offer cash on delivery (COD) at this time.

10. PRODUCT DESCRIPTIONS & AVAILABILITY

We make every effort to display our products, colours, and details accurately. However, we cannot guarantee that your device's display of any colour will be accurate. All products are subject to availability, and we reserve the right to discontinue any product at any time.

11. INTELLECTUAL PROPERTY

All designs, artwork, quotes, photographs, product names, and content on this website are the intellectual property of Sparkles & Stardust. You may not reproduce, distribute, resell, or use any content from this website for commercial purposes without our prior written consent.

 

Purchasing a product grants you personal use only. Reselling our products or using them for commercial purposes (including but not limited to reprinting our designs) is strictly prohibited.

12. USER CONDUCT

​You agree not to use the website for any unlawful purpose, to harass or abuse our team, to submit false information, or to attempt to gain unauthorized access to any part of the site or its systems.

13. THIRD-PARTY LINKS

Our website may contain links to third-party sites (Instagram, WhatsApp, Linktree, etc.). We are not responsible for the content, privacy policies, or practices of any third-party sites.

14. LIMITATION OF LIABILITY

Sparkles & Stardust shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or website. Our maximum liability in any case shall not exceed the total amount paid by the customer for the order in question.

15. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of India. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

16. GRIEVANCE REDRESSAL

In accordance with the Consumer Protection (E-Commerce) Rules, 2020, all grievances may be directed to:
